Active Union debts may be negotiated with discounts and differentiated terms by means of exceptional transaction

Based on Ordinance No. 14,402 of June 16, 2020, of the Attorney General’s Office of National Treasury – PGFN, created based on Law 13,988/2020, the conditions for Exceptional Transaction in the Collection of the Federal Government Debt are established, to help overcome the situation of economic and financial crisis due to the effects of the coronavirus (COVID-19), from the perspective of receiving credits observing the capacity of generating results of debtors.

The new exceptional transaction will offer specific benefits to individuals, educational institutions, Santas Casas de Misericórdia, legal entities, individual businessmen, micro-companies, small businesses, cooperative societies, companies in the process of judicial reorganization, judicial liquidation, extrajudicial liquidation or bankruptcy, and other civil society organizations of Law 13.019/2014 is a part.

This type of agreement makes it possible to pay the debits registered as federal debts even if they are in the execution phase or are subject to previous terminated installment payments, with or without suspended eligibility, to benefit them with reduced down payment, installments, discounts and differentiated terms, according to their payment capacity and provided that the debts are equal to or less than R$ 150 million.

It is worth mentioning that for the exceptional transaction regarding social security debts, the number of installments will remain at most 60 times, due to constitutional limitations. On the other hand, the credits considered irrecoverable or difficult to recover enrolled in active debt can be negotiated with payment of the balance within 72 months and with discount offers of up to 100% of the amount of interest, fines and legal charges.

In order to join, the applicant must provide the necessary information and accept the exceptional transaction proposal formulated by PGFN in the period from July 1, 2020, to December 29, 2020, through access to the REGULARIZE portal (www.regularize.pgfn.gov.br).
